Gampanion Service Agreement

STATEMENT: We do not authorize any third parties to operate on behalf of Gampanion. For any transaction you made with unauthorized agencies, individuals or services providers, we will not be liable for any losses and damages in connection with the use of our website.

This Agreement outlines the terms and conditions governing Gampanion Sdn Bhd (the “Company”) and the gaming companion (the “Gampanion” or “Service Provider”) business activities on www.gampanion.com and mobile application (the “Platform”). In consideration of the premises and mutual promises set forth above and below, Company and Gampanion agree as follow:

1. Partnership Details

2. Responsibilities of the Company

2.1 Company assures the approved information of Gampanion will be shown on the Platform. The information will be uploaded properly and timely.

2.2 For performance review purpose, Company will provide Gampanion the monitoring reports regarding the number of inquiries, reviews, orders and others.

2.3 Should Company received any feedback from third party regarding Gampanion’s information or performance, Company will review and evaluate the situation accordingly. Once the reported situation was verified as inappropriate and/or illegal, Company have the right to remove the relevant information and/or terminate this partnership.

2.4 Upon the registration as Gampanion, Company will collect Gampanion’s identification information for documentation purpose.

3. Responsibilities of the Gampanion 

3.1 Gampanion will provide the required information as follows:

3.1.1 Personal information (name, residence country, etc)

3.1.2 Contact information (mobile number, email, etc)

3.1.3 Identification information (identity card, passport, etc)

3.1.4 Gaming skills information (game ranking, history, etc)

3.2 Gampanion will be able to accept orders at the Platform once the information has been approved by the Company.

3.3 Gampanion are not allow to obtain privacy information (such as account password or personal contact information) from other users. Once reported, all Gampanion earnings will be forfeited and/or Company have the right to terminate this partnership.

3.4 Gampanion will:

3.4.1 Comply with country regulation and legislation: In case of any legal consequences occur in violation of the law, Gampanion will independently bear the corresponding legal responsibilities individually.

3.4.2 Not infringe the legal rights of third parties: The information/attachment/photo provided by Gampanion should not infringe on third parties (including but not limited to) patent, trademark or copyright. In case of any legal consequences occur in violation of the law, Gampanion will independently bear the corresponding legal responsibilities individually.

3.5 If there is any changes regarding Gampanion’s personal information and/or gaming qualification (such as ranking), Gampanion should provide the updated information immediately to the Company within one (1) day. The Company will upload the updated information to the Platform within three (3) days’ time.

3.6 Gampanion assure the information provided are true and accurate. This information including but not limited to:

3.6.1 Personal information (name, residence country, etc)

3.6.2 Contact information (mobile number, email, etc)

3.6.3 Identification information (identity card, passport, etc)

3.6.4 Gaming skills information (game ranking, history, etc)

3.7 In case the dishonesty caused any damages or losses to the Company and/or third parties, Gampanion will independently bear the corresponding legal responsibilities individually.

4. Termination/Cancellation of Partnership Agreement

4.1 Should one of the parties (Gampanion or Company) fails to perform any of its material obligations under this agreement, the party who holds the obligations are able to request the breaching party to stop the breaching action within a limited period. The agreement will be terminated immediately should the breaching party are not able to take compensatory action within the given time frame. 

4.2 Should the Gampanion or Company failed to hold the obligations due to any force majeure factors, Company will not have to bear the corresponding legal responsibilities. However, both parties should minimise the impacts or damages caused by any force majeure. The force majeure factors including but not limited to:

4.2.1 Internet connection, computer hardware & software, telecommunication issues

4.2.2 Strike, riot and terrorism attack

4.2.3 Natural disasters

4.2.4 Regulatory changes

4.3 In case of any disputes, both parties should go through an amicable negotiation. If negotiation fails, the case will be submitted to the People’s Court of the Company’s based country for litigation.

4.4 Prior notice of partnership cancellation: both parties could end the partnership in advance by submitting a cancellation request through email or other written method, subject to 15 days notice period.

4.5 Once the partnership been canceled, the Company have the right to:

4.5.1 Delete all the Gampanion information on the Platform

4.5.2 Stop delivering monitoring reports and other information to Gampanion

4.5.3 Keep the information of Gampanion for documentation purpose. Should there is any inappropriate or illegal actions done by Gampanion prior the cancellation of agreement, the relevant clauses in the agreement will remain effective.

5. Private and Confidential

5.1 All negotiations and fixture to be kept strictly private and confidential by all parties and shall not be reported except for certain mandatory reporting required.

5.2 Both parties should hold the obligations towards such private and confidential clauses for 3 years, after the cancellation of this agreement.

6. Others

6.1 Gampanion understands there will be server maintenance in order to ensure the Platform services, thus Gampanion will not pursue any legal liability of the Company. The Company is responsible to minimise the impacts or damages caused by any server maintenance.

6.2 Should the Platform is affected by cyber attacks, Gampanion will understand and will not pursue any legal liability of the Company. The Company is responsible to minimise the impacts or damages caused by any cyber attacks.

6.3 Unless with mutual agreement between both parties, Gampanion do not allowed to transfer this agreement to another individual.

7. Signature

7.1 Both parties acknowledges that they have read and understand this document and what it

means with respect to their participation. Both parties warrants, represents, and agrees that 

they have the full power and authority to enter into this agreement.
